These Terms of Service govern your access to and use of Kalibra’s websites, mobile applications, AI-assisted coaching, analytics, content, membership products, professional services and related services (the “Services”). The Services are provided by Kalibra PTE LTD (“Kalibra”, “we”, “us” or “our”).
By creating an account, buying a membership, connecting data, uploading information or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Plain-English Summary
- Kalibra helps you understand and act on health, lifestyle, biomarker and wearable data.
- We do not sell your personal data.
- You own the content and data you provide, but you give us permission to process it so we can operate, improve and personalise the Services.
- Kalibra does not provide medical advice, diagnosis or treatment. Always speak with a qualified clinician before making medical decisions.
- Paid subscriptions renew automatically until cancelled, unless stated otherwise at purchase.
- We may suspend or terminate accounts that misuse the Services or breach these Terms.
1. Eligibility
You must be at least 18 years old to use the Services. If you use the Services on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
2. Accounts and Security
You agree to provide accurate, current and complete account information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Tell us promptly if you believe your account has been compromised.
3. The Services
Kalibra may provide digital health tracking, AI-assisted coaching, human coaching, biomarker analysis, lab-result upload tools, nutrition-related services, professional dashboards, content and other health optimisation services. Features may vary by product, geography, membership tier and availability.
To provide the Services, Kalibra may process information you choose to share or connect, including account information, lifestyle information, wearable data, activity data, nutrition information, lab results, biomarkers, questionnaire answers, coaching notes, app interactions and other data described in our Privacy Policy and Data Protection Policy.
4. No Medical Advice
The Services are intended for education, insight, coaching and personal health optimisation. They are not medical advice and are not a substitute for professional medical diagnosis, treatment or care. Do not ignore or delay seeking medical advice because of something you see in the Services. If you have a medical emergency, contact emergency services immediately.
5. Your Data and Content
You retain ownership of the data, files, messages, lab results and other content you provide to Kalibra. You grant Kalibra a worldwide, non-exclusive licence to host, process, analyse, display, transmit and otherwise use that content as needed to provide, secure, maintain, support and improve the Services, comply with law and enforce these Terms.
You are responsible for ensuring that you have the rights and permissions needed to provide any content or third-party data to Kalibra.
6. Privacy and Data Protection
Our handling of personal data is described in our Privacy Policy and Data Protection Policy. Those policies explain what we collect, why we process it, how we protect it, when we share it and what rights may be available to you.
7. AI-Assisted Features
Some Services may use AI-assisted systems to help analyse information, summarise patterns, generate insights or support coaching workflows. AI outputs may be incomplete, inaccurate or inappropriate for your circumstances. You remain responsible for decisions you make based on the Services, and medical decisions should be made with qualified professionals.
8. Labs, Partners and Third-Party Services
Some Services may involve third-party labs, wearable platforms, payment processors, app stores, cloud providers, analytics providers or professional partners. Your use of third-party services may be subject to their own terms and privacy policies. Kalibra is not responsible for third-party services that we do not control.
9. Fees, Subscriptions and Renewal
Some Services require payment. Prices, billing intervals, included features and renewal terms are shown at purchase or in your account. Unless stated otherwise, subscriptions renew automatically until cancelled. You authorise us or our payment providers to charge the applicable fees, taxes and any other amounts due using the payment method on file.
You can cancel according to the cancellation flow for the channel where you purchased the Services, such as the Kalibra website, Apple App Store or Google Play Store. Cancellation stops future renewal but does not automatically refund past charges unless required by law or expressly stated at purchase.
10. Acceptable Use
You agree not to misuse the Services, interfere with their security or operation, access them using unauthorised methods, reverse engineer them, scrape them, upload malicious code, infringe anyone’s rights, submit unlawful or harmful content, or use the Services in a way that could harm Kalibra, other users or third parties.
11. Professional and Employer Use
If you access Kalibra through a clinician, coach, employer, insurer, partner or other organisation, additional terms or notices may apply. Where required, you must only access data for individuals you are authorised to support and must comply with applicable confidentiality, privacy and professional obligations.
12. Intellectual Property
Kalibra and its licensors own the Services, software, designs, trademarks, analytics, content, methods and related intellectual property, except for content you provide. These Terms do not transfer ownership of Kalibra intellectual property to you.
13. Feedback
If you provide suggestions, ideas or feedback, you allow Kalibra to use them without restriction or compensation.
14. Service Changes and Availability
We may change, suspend or discontinue parts of the Services at any time. We aim to keep the Services reliable but do not guarantee that they will always be available, uninterrupted or error-free.
15. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, create risk for Kalibra or others, fail to pay fees, or if we are required to do so by law. After termination, some provisions of these Terms will continue where their nature requires it.
16. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Kalibra disclaims all warranties, whether express, implied or statutory, including warranties of accuracy, fitness for a particular purpose, merchantability and non-infringement.
17. Limitation of Liability
To the maximum extent permitted by law, Kalibra will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity. Kalibra’s total liability for claims relating to the Services will be limited to the amounts you paid to Kalibra for the Services in the 12 months before the event giving rise to the claim, unless a different limit is required by law.
18. Indemnity
You agree to indemnify and hold Kalibra harmless from claims, losses, liabilities, damages, costs and expenses arising from your misuse of the Services, breach of these Terms, violation of law or infringement of third-party rights.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version on our website and update the date above. Your continued use of the Services after the updated Terms take effect means you accept them.
20. Governing Law
These Terms are governed by the laws of Singapore, unless applicable law requires otherwise. Courts in Singapore will have jurisdiction over disputes relating to these Terms, subject to any mandatory consumer rights that apply in your location.
